Terms of Service

1Agreement to Terms

By downloading, installing, accessing, or using the Ghosted mobile application (“App,” “Service,” or “Ghosted”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and Ghosted (“we,” “us,” or “our”). We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify you of material changes through the App or via email.

2Eligibility

You must be at least 17 years of age to use Ghosted. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3Description of Service

Ghosted is a job application tracking and career intelligence platform that provides:

• Application Pipeline Management — Track job applications across statuses including Applied, Interview, Offer, Rejected, Ghosted, and Withdrawn.
• Company Intelligence — Access community-powered data on employer responsiveness, including ghost rates and response statistics.
• AI-Powered Tools — Generate cover letters, follow-up emails, interview preparation materials, tailored resumes, and weekly coaching reports using artificial intelligence (available to subscribers).
• Job Posting Import — Parse job postings from screenshots or URLs to auto-fill application details.
• Analytics and Insights — View application velocity, conversion rates, status breakdowns, industry trends, and other career analytics.
• Notifications — Receive follow-up reminders and optional daily motivation messages.
• Data Export — Export application data in CSV format (available to subscribers).

4User Accounts

4.1 Account Creation

To use Ghosted, you must create an account using either:

• A valid email address and password, or
• Sign in with Apple.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4.3 Account Security

You must immediately notify us if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.4 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent usage limits, subscription restrictions, or for any other purpose is prohibited.

5Subscriptions and Payments

5.1 Free Tier

Ghosted offers a free tier with limited functionality, including:

• A maximum of 5 tracked applications.
• Limited access to company browse features.
• Limited access to insights and analytics.
• No access to AI-powered features, data export, or company watch alerts.

5.2 Super Ghosted Subscription

Premium features are available through the “Super Ghosted” subscription, offered as:

• Monthly — A recurring monthly subscription.
• Yearly — A recurring annual subscription.
• Lifetime — A one-time purchase granting permanent access to all premium features.

5.3 Payment Processing

All payments are processed exclusively through the Apple App Store. By purchasing a subscription, you agree to Apple’s terms of service and payment policies. We do not directly process, store, or have access to your payment card information.

5.4 Subscription Renewal and Cancellation

• Monthly and yearly subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You may manage or cancel your subscription at any time through your Apple ID account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
• No partial refunds are provided for unused portions of a subscription period.

5.5 Refunds

Refund requests must be directed to Apple through the App Store, as Apple handles all billing. We do not have the ability to issue refunds directly.

5.6 Price Changes

We reserve the right to change subscription pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following notice of the change. If you do not agree to a price change, you may cancel your subscription before it renews.

5.7 Lifetime Purchase

The Lifetime purchase grants access to all features available at the time of purchase and any future features included in the Super Ghosted tier for the operational lifetime of the App. “Operational lifetime” means the period during which we actively maintain and distribute the App. A Lifetime purchase does not guarantee perpetual availability of the App or its services.

6AI-Powered Features

6.1 Nature of AI Content

Ghosted uses artificial intelligence to generate cover letters, follow-up emails, interview preparation materials, tailored resumes, weekly coaching reports, and other content. You acknowledge and agree that:

• AI-generated content is provided “as-is” and for informational and assistive purposes only. It does not constitute professional career advice, legal advice, or guaranteed employment outcomes.
• AI output may contain errors, inaccuracies, or inappropriate suggestions. You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it in any professional or personal context.
• We make no guarantees regarding the quality, accuracy, completeness, suitability, or effectiveness of AI-generated content.
• You assume all risk associated with using AI-generated content, including but not limited to sending AI-drafted communications to employers, using AI-generated interview preparation, or relying on AI coaching advice.

6.2 AI Data Processing

To provide AI features, certain data you provide (including but not limited to company names, job titles, job posting text, resume text, applicant profile information, and application details) is transmitted to our server infrastructure for processing by AI models. By using AI features, you consent to this data transmission and processing. See our Privacy Policy for full details.

6.3 AI Usage Limits

AI features are subject to daily usage limits that reset at midnight. We reserve the right to modify these limits at any time without notice. Attempts to circumvent usage limits may result in suspension or termination of your account.

6.4 No Guarantee of AI Availability

AI features depend on third-party infrastructure and may be temporarily unavailable due to maintenance, outages, or other factors beyond our control. We do not guarantee uninterrupted availability of AI features and shall not be liable for any loss or inconvenience resulting from AI feature unavailability.

7User Data and Content

7.1 Your Data

You retain ownership of all data you input into Ghosted, including application details, company information, notes, resume text, and any other personal content. By using the App, you grant us a limited, non-exclusive license to store, process, and transmit your data solely for the purpose of providing the Service to you.

7.2 Aggregate and Anonymous Data

You acknowledge and agree that we may collect and use anonymized, aggregated data derived from user activity to compute community statistics, including but not limited to company ghost rates, response statistics, and industry trends. This aggregated data does not personally identify you and may be displayed publicly within the App.

7.3 Data Accuracy

You are solely responsible for the accuracy and completeness of data you enter into the App. We are not responsible for any consequences arising from inaccurate or incomplete data entry.

7.4 Prohibited Content

You agree not to input, upload, or transmit through the App any content that:

• Is unlawful, defamatory, obscene, or otherwise objectionable.
• Infringes on the intellectual property rights of any third party.
• Contains malicious code, viruses, or harmful data.
• Is intended to abuse, exploit, or overload the Service.
• Contains personally identifiable information of third parties without their consent.
• Is false or misleading in a manner intended to manipulate community statistics.

7.5 Content Removal

We reserve the right to remove any user content that violates these Terms or that we determine, in our sole discretion, to be harmful to the Service or its users.

8Company Intelligence and Ghost Rate Data

8.1 Community-Powered Data

Company ghost rates, response statistics, and employer intelligence displayed in the App are derived from aggregated, anonymized user data. This data reflects the collective experience of Ghosted users and may not represent the complete hiring practices of any company.

8.2 No Endorsement or Defamation

The display of company statistics within the App does not constitute an endorsement, recommendation, or defamation of any company. Ghost rates and related metrics are mathematical calculations based on user-reported application outcomes and carry no editorial judgment.

8.3 Accuracy Disclaimer

We do not independently verify the accuracy of user-reported application statuses. Company statistics may be influenced by factors including but not limited to sample size, user reporting bias, and timing. You should not rely solely on Ghosted data when making employment decisions.

9Acceptable Use

You agree to use Ghosted only for its intended purpose of job application tracking and career management. You shall not:

• Use the App to harass, stalk, or harm any individual or organization.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use automated systems, bots, or scripts to interact with the App.
• Attempt to gain unauthorized access to our servers, databases, or other infrastructure.
• Circumvent or attempt to circumvent any usage limits, subscription restrictions, or security measures.
• Resell, redistribute, or sublicense access to the App or any of its features.
• Use AI-generated content to impersonate another person or create misleading communications.
• Submit false application data with the intent to manipulate company statistics.
• Use the App in any manner that could damage, disable, overburden, or impair the Service.
• Scrape, harvest, or collect data from the App through any means not expressly authorized.

Violation of these terms may result in immediate suspension or termination of your account without notice or refund.

10Intellectual Property

10.1 Our Property

The App, including its design, code, features, branding, logos, UI elements, and all related intellectual property, is owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the App as described herein.

10.2 AI-Generated Content

Content generated by our AI features is provided to you for your personal and professional use. You may use, modify, and distribute AI-generated content at your discretion. However, we make no representations regarding the originality or intellectual property status of AI-generated content, and you use it at your own risk.

10.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without obligation or compensation to you.

11Third-Party Services

11.1 Integration with Third Parties

Ghosted integrates with third-party services including but not limited to:

• Apple App Store for payment processing and distribution.
• Sign in with Apple for authentication.
• Supabase for backend infrastructure and data storage.
• RevenueCat for subscription management.
• TelemetryDeck for privacy-focused analytics.

11.2 Third-Party Terms

Your use of the App may be subject to the terms of service and privacy policies of these third-party providers. We are not responsible for the practices, policies, or availability of third-party services.

11.3 No Liability for Third Parties

We are not liable for any loss, damage, or inconvenience caused by the unavailability, malfunction, or changes to any third-party service that the App relies upon.

12Account Termination

12.1 Termination by You

You may delete your account at any time through the App’s Profile settings. Account deletion will permanently remove all your data from our servers and your device. This action cannot be undone.

12.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include but are not limited to:

• Violation of these Terms.
• Abusive or fraudulent behavior.
• Extended periods of inactivity.
• Legal or regulatory requirements.

12.3 Effect of Termination

Upon termination:

• Your access to the App and all associated features will cease immediately.
• Your data will be deleted in accordance with our Privacy Policy.
• Any active subscription will not be automatically canceled — you must cancel through Apple.
• We are not obligated to provide any data export after termination.

13Disclaimers

14Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

15Indemnification

You agree to indemnify, defend, and hold harmless Ghosted, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use or misuse of the App.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Any content you submit, post, or transmit through the App.
• Your use of AI-generated content in any context.
• Any claim that data you provided infringes on the rights of a third party.

16Dispute Resolution

16.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us and attempt to resolve the dispute informally for a period of at least thirty (30) days.

16.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we are incorporated, without regard to conflict of law principles.

16.3 Arbitration

Any dispute arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved through binding arbitration, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. The arbitration shall be conducted in accordance with the rules of a recognized arbitration body in the governing jurisdiction.

16.4 Class Action Waiver

17Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ghosted regarding your use of the App.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment

We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, labor disputes, government actions, power failures, internet or telecommunications failures, or failures of third-party service providers.
